## What the platform does

- Automated call campaigns (Autodialer) with a visual call-flow editor, voice robot and voicemail
- SMS and e-mail consent campaigns; WhatsApp only after a YES given by call, SMS or e-mail, or when the person wrote first on WhatsApp
- Callback: replies and messages from recipients reach the company
- Consent register (log of YES/NO answers, kept as proof) and an exclusion list for refusals

## How consent works

1. The accommodation provider is found in public sources.
2. The provider is asked whether they want information about the service.
3. The information is sent only after a YES. Silence or no answer is not consent. A NO (or STOP, or pressing 8 during the call) adds the number to the exclusion list immediately, on all channels.

- Google Maps: information published by accommodation providers in their own profile (name, phone, locality and, if published, address, e-mail, website)
- SITUR (General Directorate for Tourism, Ministry of Economy, Entrepreneurship and Tourism): list of classified accommodation published by the ministry (no licence stated by the publisher), https://se.situr.gov.ro, updated daily (name, type, category, town, operator, CUI, e-mail and website if published; no phone, the phone comes from ANAF by CUI)
- ANAF: newly registered companies (CUI, name, address, CAEN code, phone if declared)
- ONRC open data on data.gov.ro

## Legal basis

- Law no. 506/2004, art. 12: commercial communications by automated call, e-mail or other electronic means only with prior express consent
- Regulation (EU) 2016/679 (GDPR): legitimate interest (art. 6(1)(f)) for the question; consent (art. 6(1)(a)) for the presentation of the service; art. 4(11), 7, 14, 21 and 5

- Regulation (EU) 2024/1689 (AI Act), art. 50 (transparency, applies from 2 August 2026): people are informed they interact with an AI system; AI-generated audio is marked as such. The voice of the automated call messages is generated with AI from our text, and the call states this at the start.
- ANCOM regulations on caller identification and the use of numbering resources: the number shown must belong to the caller and be callable back. Calls are made from +40 726 356 855, shown on the call and callable back during and outside business hours; voicemail messages are returned within 48 hours at most.

For PFA, sole proprietorships and family businesses this data is personal data, processed under the GDPR.
- Processors: Cloudflare, Inc. (USA) delivers the public website (CDN and secure tunnel) and sees visitor IP addresses and technical data; transfer based on the EU-US Data Privacy Framework. Tailscale, Inc. (USA) provides the VPN for administrator access to the server and sees device IP addresses and metadata only, not application or prospect data; transfer based on SCCs in its DPA. OpenAI (USA) and ElevenLabs (UK) are used only to generate the voice of audio messages from our own texts; they receive no phone numbers, names or other personal data. WhatsApp messages are transmitted through Meta Platforms, which may process numbers and messages outside the EU; the transfer is based on the EU-US Data Privacy Framework.
- Voice messages: in automated calls and with the answering robot the conversation is not recorded; only voice messages people choose to leave (robot, voicemail, “Leave a message” in a call) are recorded, to call back and handle the request (the person's request and legitimate interest, GDPR art. 6(1)(f)). They are kept until the request is resolved, 30 days at most, then deleted automatically.

## Infrastructure

- On-premise server on the company's own infrastructure; application and prospect data are not hosted by third parties; the public website is delivered through Cloudflare
- The application is private: reachable only over a VPN, with username and password, operated by the Administrator
- Calls and SMS go out through a LILYGO T-SIM7600G-H modem board
